Como parte de una delegaci\u00f3n internacional  para verificar la actividad ilegal, ACSN presenci\u00f3 una de las  retroexcavadoras trabajando ilegalmente, (ver la foto abajo), en la  localidad de San Juan, municipio de Suarez, \u00e1rea de La Toma.  <!--more-->  <\/p>\n<p>\u00a0<\/p>\n<h2>Reporte de la Red de Solidaridad con Comunidades Afro-Colombianas (ACSN)*<\/h2>\n<p><strong>ACSN Respalda los Resultados de La Misi\u00f3n de Verificaci\u00f3n en La Toma<br \/><\/strong><br \/>Miembros de la Red de Solidaridad con Comunidades Afrocolombianas (ACSN por sus siglas en Ingles) verific\u00f3 ayer la presencia de tres de las ocho retroexcavadoras presentes en la zona, que la Red denunci\u00f3 en su comunicado del 20 de Julio. Como parte de una delegaci\u00f3n internacional para verificar la actividad ilegal, ACSN presenci\u00f3 una de las retroexcavadoras trabajando ilegalmente, (ver la foto abajo), en la localidad de San Juan, municipio de Suarez, \u00e1rea de La Toma. El grupo de verificaci\u00f3n observo tambien la presencia de dos retroexcavadoras m\u00e1s en las proximidades al \u00e1rea que no parecen estar en operaci\u00f3n. <\/p>\n<p>La misi\u00f3n de verificaci\u00f3n estuvo conformada por representantes nacionales e internacionales y fue organizada por el Proceso de Comunidades Negras (PCN), Grupo de Protecci\u00f3n (GTP), la Corporaci\u00f3n Sembrar, NOMADESC, PCS y la Corporaci\u00f3n Norte Sur. ACSN verific\u00f3 no solo la presencia ilegal de esta\u00a0 Maquinaria sino tambi\u00e9n la presencia de trabajadores e intensa actividad de excavaci\u00f3n a algunos metros del R\u00edo Ovejas en San Juan. Esta maquinaria y miner\u00eda ilegal viola la Sentencia de la Corte Constitucional 1045A, por la cual la Corte declara ilegal toda actividad minera por fuera de las pr\u00e1cticas ancestrales tradicionales de las comunidades y demanda que el Consejo Comunitario sea consultado y se obtenga su previo consentimiento antes de cualquier actividad minera for\u00e1nea. Es tambi\u00e9n una violaci\u00f3n a la Ley 685, C\u00f3digo minero colombiano, que establece que no debe haber actividad minera a menos de 600 metros de una fuente de agua. ACSN pudo confirmar intensa actividad de excavaci\u00f3n, como lo muestra la foto abajo en la propia margen del Rio Ovejas, \u00fanica fuente de agua para las comunidades del \u00e1rea. La falta de una acci\u00f3n ejecutiva y seguimiento inmediato por parte de las autoridades es una violaci\u00f3n de la ley y de la Sentencia 1405-A, que ha permitido no solo que los mineros permanezcan en el \u00e1rea sino tambi\u00e9n en actividades mineras ilegales.<\/p>\n<p>La misi\u00f3n fue informada por uno de los trabajadores encontrados en el \u00e1rea de miner\u00eda ilegal en San Juan, que los mineros han estado esperando por la orden del Alcalde para evacuar la maquinaria. De acuerdo con esta persona, el alcalde ha estado muy ocupado para sacar la orden. El Consejo Comunitario y autoridades ind\u00edgenas tambi\u00e9n est\u00e1n esperando por la orden que el Alcalde de Su\u00e1rez prometi\u00f3 en Junio 15, durante una Mesa Minera (reuni\u00f3n con la comunidad para discutir la problem\u00e1tica minera), para desalojar de las comunidades mineros ilegales y sus maquinarias, cuya presencia ilegal se hab\u00eda reportado en mayo.<\/p>\n<p>La falta de una orden ejecutiva y la acci\u00f3n inmediata de las autoridades para hacerla efectiva, es una violaci\u00f3n de la ley y de la Sentencia 1405-A, que ha permitido no solo que los mineros permanezcan en el \u00e1rea sino tambi\u00e9n en actividad minera ilegalmente. Despu\u00e9s de inspeccionar el \u00e1rea donde se esta dando la miner\u00eda ilegal, la misi\u00f3n se reuni\u00f3 con el Personero Municipal de Su\u00e1rez quien expreso que las autoridades locales no tienen la capacidad ni los recursos para atender la situaci\u00f3n. Ir\u00f3nicamente, el a\u00f1o pasado las autoridades municipales fueron muy diligentes en movilizar fuerzas de polic\u00eda para desalojar a los mineros tradicionales de sus tierras, protegiendo los intereses de un minero for\u00e1neo que clamaba derecho sobre las tierras de las comunidades, sobre los derechos de estas comunidades Afrodescendientes asentadas desde1636.<\/p>\n<p>ACSN y otras organizaciones de derechos humanos y ambientales como Censat Agua Viva de Colombia, han hecho seguimiento a la continua presencia ilegal de las retroexcavadoras en el \u00e1rea de La Toma. En Mayo, otra misi\u00f3n verifico la presencia de cuatro retroexcavadoras que entraron ilegalmente, sin ninguna respuesta de las autoridades para prevenirlo.<\/p>\n<p>La Red de Solidaridad Afrocolombiana deplora la falta de acci\u00f3n por parte de las autoridades locales y nacionales para atender esta cr\u00edtica situaci\u00f3n que no solo esta causando severo da\u00f1o ambiental sino tambi\u00e9n problemas de seguridad y estigmatizaci\u00f3n para los miembros del Consejo Comunitario y sus l\u00edderes.<\/p>\n<p>M\u00e1s aun, ACSN esta profundamente preocupada por la seguridad de los l\u00edderes y miembros del Consejo Comunitario que contin\u00faan recibiendo amenazas de muerte por defender los derechos de las comunidades y el cumplimiento de la ley.<\/p>\n<p>Hasta el momento, no hemos conocido de ninguna investigaci\u00f3n seria sobre estas amenazas y, como se confirmo durante la misi\u00f3n de verificaci\u00f3n, no hay una respuesta efectiva de ninguna de las autoridades responsables remediar esta terrible situaci\u00f3n.<\/p>\n<p>Como Red que ha venido monitoreando la violaci\u00f3n de los derechos en La Toma y ha reportando constantemente esos abusos, urgimos a las autoridades competentes nacionales por lo siguiente: <\/p>\n<p>-Asegurar que las autoridades del municipio de Su\u00e1rez cumplan de manera inmediata y efectiva con la Sentencia de la Corte Constitucional 1045-A y el Auto 005 del 2009, con el fin de detener la actividad minera ilegal y proteger la integridad de los lideres, de la poblaci\u00f3n y los derechos de las comunidades. <\/p>\n<p>-Que el Ministerio del Interior y la Oficina de Asuntos para Comunidades Afrodescendientes deben actuar de manera diligente para garantizar la protecci\u00f3n de las Comunidades y personas amenazadas y a las autoridades competentes adelantar la investigaci\u00f3n de estos hechos y llevar a los responsables frente a la justicia.<\/p>\n<p>-Que la Fiscal\u00eda General de la Naci\u00f3n investigue y penalice a todas las personas implicadas en la miner\u00eda ilegal en el \u00e1rea de Consejo Comunitario de La Toma.<\/p>\n<p>-Conducir una investigaci\u00f3n disciplinaria exhaustiva de las autoridades municipales y nacionales que han fallado en su obligaci\u00f3n hacer cumplir la ley y de proteger los derechos de las comunidades Afrodescendientes de La Toma, en la municipalidad de Su\u00e1rez.<\/p>\n<p>-Finalmente ACSN aspira a que el Gobierno Colombiano tome seriamente el problema de la miner\u00eda ilegal no solo en La Toma sino tambi\u00e9n en todos los territorios Afrodescendientes donde se presenta este problema. Las autoridades locales y nacionales deben cumplir con la Orden 005 del 2009 y la Sentencia 1405-A de la Corte Constitucional, las cuales definen claramente las v\u00edas y mecanismos para asegurar resolver el problema de la miner\u00eda ilegal, proteger a la vida y derechos de las comunidades y sus lideres y proteger la integridad f\u00edsica y cultural de las comunidades Afrodescendientes.<\/p>\n<p><span><span><span style=\"font-size: x-small;\"><span style=\"font-size: x-small;\"><span style=\"font-size: x-small;\"> <\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE2964C10t00; The delegation not only verified the presence of<\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">this machinery, but a group of workers and intensive digging activity by meters from the Ovejas River in San Juan.This <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">machinery and illegal mining violates Constitutional <\/span><\/span><span style=\"font-family: TTE19B25D0t00; color: blue;\"><span style=\"font-family: TTE19B25D0t00; color: blue;\">Court Sentence 1045-A <\/span><\/span><span style=\"font-family: TTE19B25D0t00; color: black;\"><span style=\"font-family: TTE19B25D0t00; color: black;\">which declares as illegal any mining activity <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">aside from the traditional ancestral mining practice of the communities, and demands that the Community Council of La <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">Toma must be consulted and provide consent prior to any foreign mining activity. It is also a violation of Law 685, <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">Colombia<\/span><\/span><span style=\"font-family: TTE19B25D0t00; color: black;\"><span style=\"font-family: TTE19B25D0t00; color: black;\">\u2019s mining code, which declares that mining activity is illegal within 600 meters of a source of water. The delegation <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">confirmed the existence of illegal mining, as the picture shows, on the margin of the Ovejas River, the only source of water for <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">communities in the area. The mission was informed by one of the workers in the illegal mining area of San Juan that the<\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">miners have been waiting for the order from the Mayor of Suarez to remove the machinery from the area. However, according <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">to the worker, the Mayor has been too busy to issue the order. The Community Council and Indigenous authorities are also <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">waiting for an order that the Mayor of Suarez promised to issue on June 15<\/span><\/span><span style=\"font-family: TTE19B25D0t00; color: black; font-size: xx-small;\"><span style=\"font-size: 8pt; font-family: TTE19B25D0t00; color: black;\">th <\/span><\/span><span style=\"font-family: TTE19B25D0t00; color: black;\"><span style=\"font-family: TTE19B25D0t00; color: black;\">during a <\/span><\/span><span style=\"font-family: TTE2958A78t00; color: black;\"><span style=\"font-family: TTE2958A78t00; color: black;\">Mesa Minera <\/span><\/span><span style=\"font-family: TTE19B25D0t00; color: black;\"><span style=\"font-family: TTE19B25D0t00; color: black;\">(meeting to discuss the <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">mining issues in the municipality), to evict the illegal miners and their machinery that were reported illegally present<\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">in La Toma in May.<\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\"> <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">The lack of executive actions and immediate actions and follow up by the authorities is a violation of the law and the Sentence <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">1405A that has allowed the miners to not only remain in the area but also to be actively engaged in illegal mining. After inspecting <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">the site of the illegal mining, the mission met with the spokesman of Suarez (<\/span><\/span><span style=\"font-family: TTE2958A78t00; color: black;\"><span style=\"font-family: TTE2958A78t00; color: black;\">Personero Municipal<\/span><\/span><span style=\"font-family: TTE19B25D0t00; color: black;\"><span style=\"font-family: TTE19B25D0t00; color: black;\">) of the municipality of Suarez, <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">who expressed that the local administration does not have the capacity and resources to halt the situation. Ironically, last year, the <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">municipal authorities were very diligent to mobilize police forces to evict traditional miners from their lands to protect the interest of <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">a foreigner, who claimed rights to the communities\u2019 lands, over the rights of those Afro-descendant communities settled since 1636.<\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">ACSN and other human rights and environmental organizations such as <\/span><\/span><span style=\"font-family: TTE2958A78t00; color: black;\"><span style=\"font-family: TTE2958A78t00; color: black;\">Censat Agua Viva <\/span><\/span><span style=\"font-family: TTE19B25D0t00; color: black;\"><span style=\"font-family: TTE19B25D0t00; color: black;\">of Colombia, have been following up on <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">the illegal presence of excavators in the area of La Toma. In May, another mission verified the illegal presence of four excavators that <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">were brought to the area without any response from the local authorities to prevent it.The Afro-Colombian Solidarity Network deplores the lack of action on behalf of the authorities at the local and national levels, to address these critical issues that are causing severe environmental damage, security problems and stigmatization to the Community Council members and leaders. Furthermore, ACSN is deeply concerned for<\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">the security of the Community Council members and leaders who continue receiving death threats because of their advocacy for the rights<\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">of the communities and the adherence to the rule of law. So far, we don\u2019t know of any serious investigation of these threats and as it was confirmed during the verification mission, there has not been an effective response from any the authorities responsible to remedy this outrageous situation. <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\"> <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">As a network that has been monitoring the violation of rights in La Toma and constantly reporting on such abuses, we strongly urge the Colombian national authorities to do the following:<\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE1C1B008t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE1C1B008t00; color: black;\"> <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE1C1B008t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE1C1B008t00; color: black;\">&#8211; <\/span><\/span><span style=\"font-family: TTE19B25D0t00; color: black;\"><span style=\"font-family: TTE19B25D0t00; color: black;\">Ensure that the authorities in the municipality of Suarez comply immediately and effectively<\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">with the Constitutional Court Sentence 1045-A and Order 005\/2009, to stop the illegal mining<\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">activity and protect the integrity and rights of leaders and community.<\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE1C1B008t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE1C1B008t00; color: black;\"> <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE1C1B008t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE1C1B008t00; color: black;\">&#8211; <\/span><\/span><span style=\"font-family: TTE19B25D0t00; color: black;\"><span style=\"font-family: TTE19B25D0t00; color: black;\">The Minister of Interior and the Office of Afro-descendant Affairs, to act diligently to ensure<\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span style=\"font-family: TTE19B25D0t00; color: black; font-size: small;\"><span style=\"font-size: 12pt; font-family: TTE19B25D0t00; color: black;\">the protection of the communities and the persons threaten.
