El 30 de Agosto 2011, la comunidad ind\u00edgena de Tacuey\u00f3, reunidad en asamblea, discute y analiza las situaciones de conflicto armado, tierras, narcotr\u00e1fico, miner\u00eda y leyes que afectan a \u00e9sta comunidad y su territorio en el norte del Cauca. En dicha asamblea se hizo un an\u00e1lisis de contexto general a trav\u00e9s de las intervenciones a modo de ponencia de personas que trabajan sobre estos temas y los aportes de comuneros, comuneras y gobernadores asistentes a la asamblea.<\/p>\n

Uno de los temas tratados hace referencia a la politica \u201cminero-energ\u00e9tica\u201c del gobierno, que \u201cest\u00e1 dise\u00f1anda para la entrega del petroleo, agua y oro a las multinacionales extractoras de minerales preciosos, donde la Anglo Gold Ashanti, que ha solicitado gran parte del territorio colombiano, se observa que tiene un porcentaje muy alto de solucitudes de concesi\u00f3n minera que se han hecho en territorio indigena, y producto de la mineria hoy los campos se han convertido en escenarios de guerra como la que esta viviendo Tacueyo\u201c. Expresa un participante de la asamblea.<\/p>\n
Adem\u00e1s se reconoce que \u00e9sta pol\u00edtica est\u00e1 acompa\u00f1ada de diferentes leyes que, para ajustarse a la extracci\u00f3n minera, se han modificado para garantizar la explotaci\u00f3n. \u201cAnteriormente el suelo y el subsuelo le pertenec\u00edan a la Naci\u00f3n y con la ley 685, el subsuelo pas\u00f3 a manos del Estado con el fin de tener el control territorial y poder decidir sobre predios titulados a particulares\u201c, agrega un comunero.<\/p>\n
El estatuto de desarollo rural, ley que afectaba a las comunidades ind\u00edgenas, fue declarada inexequible por la corte constitucional dado que no se realiza la consulta previa a dichas comunidades como lo establece el convenio de la OIT; hoy el gobierno nuevamente, despues de haberse declarado inconstitucional, pretende revivir dicha ley con el nuevo nombre de ley de desarrollo rural manifestandose all\u00ed que se va a modernizar el campo pero, \u00bfque significa eso para gente?; no es m\u00e1s que la pretenci\u00f3n de que los campesinos, afros e ind\u00edgenas trabajen para las multinacionales y se invierta en la construcci\u00f3n de grandes y pavimentadas carreteras para despu\u00e9s llevarse toda la riqueza extra\u00edda de nuestras tierras con nuestro trabajo.<\/p>\n
All\u00ed tambi\u00e9n se hizo \u00e9nfasis en la Ley de victimas y restituci\u00f3n de tierras, en cuanto a que con esa ley se pretende la legalizaci\u00f3n de cinco millones de hect\u00e1reas de las siete que fueron robadas a campesinos a trav\u00e9s de destierros violentos, desalojos, persecusiones, asesinatos, etc., lo que ha provocado la agudizaci\u00f3n de la guerra en el pa\u00eds. El Estado con esta ley s\u00f3lo manifiesta devolver dos millones de hect\u00e1reas agregando que este proceso debe estar sujeto a la sostenibilidad fiscal.<\/p>\n
La sostebilidad fiscal es como un arma de doble filo, porque m\u00e1s all\u00e1 de que el Estado reconozca un propietario campesino como leg\u00edtimo due\u00f1o de un predio y que esas tierras le fueron arrebatadas por la violencia, el gobierno menciona que se est\u00e1 en pleno derecho de exigir pero que ese derecho ser\u00e1 resarcido s\u00f3lo si dentro del presupuesto hay recursos econ\u00f3nicos, de lo contrario, no se devolver\u00e1n las tierras a los legitimos due\u00f1os, es decir, a los campesinos, ind\u00edgenas y afros v\u00edctimas de estas leyes de guerra. \u201cTodo esta politica\u00a0 tiene un enfoque capitalista y de agresi\u00f3n contra la sociedad al igual que son los trados comerciales\u201c ampl\u00eda un mayor Nasa.<\/p>\n
Como el objetvo de la asamblea era contextualizar y desarrollar diferentes temas, tambi\u00e9n se enfoc\u00f3 en el c\u00f3mo el Cabildo, con la llegada de las multinacionales, el narcotrafico, la presencia de grupos armados legales e ilegales y la compra de motos robadas, ser\u00eda la autoridad tradicional m\u00e1s apropiada para realizar el control territorial y disminuir la violencia.<\/p>\n
\u201cNo es tarea f\u00e1cil enfrentarnos a estos temas que se han planteado, pero hemos venido realizando acciones muy concretas en el momento: vigilar qui\u00e9n ingresa a nuestro territorio y con qu\u00e9 fines, adem\u00e1s se ha establecido una base de datos para identificar a personas que han comprado motos robadas y las utilizan como medio de trasporte y de esa manera tambi\u00e9n ayudamos a disminuir el hurto de motos.\u201c Comenta el gobernador del Cabildo.<\/p>\n
Hoy es tarea de todos velar por nosotros mismos y trabajar de la mano con la autoridad, pero adem\u00e1s concientizarnos de que as\u00ed como las motos robadas desestabilizan nuestro territorio, por otra parte, la guerra nos acaba y el narcotr\u00e1fico, con la siembra de cultivos de usos il\u00edcitos, aporta al hecho de que nos est\u00e9n asesinando y persiguiendo, por eso en conjuto trabajaremos para erradicar estos problemas, expresa la comunidad. Este proceso de revisi\u00f3n queda como tarea al recorrer las veredas y todo el territorio.<\/p>\n
Tejido de comunicaci\u00f3n<\/strong><\/p>\n \u00a0<\/p>\n Otro idimomas, Aleman e Ingles<\/strong><\/p>\n Das Kritische an den Gesetzen und dem Bergbau<\/strong><\/p>\n Am 30. August 2011 versammelte sich die indigene Gemeinschaft von Tacuey\u00f3, um die Situation des bewaffneten Konfliktes, des Landes, des Drogenhandels, des Bergbaus und der Gesetze zu besprechen, die die Gemeinschaft in ihrem Territorium in Nordcauca beeinflussen.\u00a0 In dieser Versammlung gab es eine Analyse des Kontextes, die durch Vortr\u00e4ge von Personen, die in diesen Themenbereichen arbeiten, und durch Beitr\u00e4ge der Gemeinschaftsmitglieder sowie Gouverneure unterst\u00fctzt wurde. <\/p>\n Eines dieser Themen nimmt Bezug auf die Politik der \u201eminero-energ\u00e9tica\u201c der Regierung, die \u201ef\u00fcr die Auslieferung von Erd\u00f6l, Wasser und Gold an die multinationalen Konzernen entworfen wurde. Diese Konzerne beanspruchen einen gro\u00dfen Teil Kolumbiens und der Vorkommnisse wertvoller Mineralien. Anglo Gold Ashant beispielsweise besitzt einen gro\u00dfen Teil der Konzessionsvertr\u00e4ge f\u00fcr Mineralien, welche sich auf indigenem Gebiet befinden. Diese Gebiete haben sich auf Grund des Bergbaus in Kriegsschaupl\u00e4tze verwandelt, so auch Tacuey\u00f3.\u201c, sagt ein Teilnehmer der Versammlung. <\/p>\n Diese Politik wird von verschiedenen Gesetzen begleitet, die, um den Bergabbau zu garantieren, modifiziert und angepasst wurden. \u201eFr\u00fcher haben der Grund und der Untergrund der Nation geh\u00f6rt. Mit dem Gesetz 685 kam der Untergrund in die H\u00e4nde des Staates, der nun die territoriale Kontrolle und somit die Macht hat, dar\u00fcber zu entscheiden, an welche Privatpersonen die kostbaren Landtitel gehen\u201c,\u00a0 erg\u00e4nzt ein Gemeinschaftsmitglied. <\/p>\n Das Statut der l\u00e4ndlichen Entwicklung, ein Gesetz, das die indigenen Gemeinschaften beeinflusst, wurde als unhaltbar deklariert, weil das Abkommen der ILO nicht eingehalten wurde. Diese besagt, dass die Gemeinschaften zuerst konsultiert werden m\u00fcssen. Heute versucht die Regierung jenes Gesetz, das als verfassungswidrig deklariert worden war, unter dem neuen Namen \u201eGesetz der ruralen Entwicklung\u201c wiederzubeleben. Dadurch soll es zu einer Modernisierung des Landes kommen. Aber was bedeutet das f\u00fcr die betroffenen Personen? Im Grunde ist es nichts Anderes, als die Bestrebung, die Bauern, Afro-KolumbianerInnen und Indigenen f\u00fcr die multinationalen Konzerne arbeiten zu lassen und das Ansinnen, gro\u00dfe Stra\u00dfen zu errichten, auf denen sp\u00e4ter der Reichtum der Erde und derArbeit davongetragen wird. <\/p>\n In der Versammlung wurde auch das Gesetz der Opfer und der R\u00fcckerstattung des Landes besprochen. Mit diesem Gesetz werden jene 5000 der insgesamt 7000 gestohlenen Hektar legalisiert. Dieses Land wurde den Bauern durch gewaltvolle Vertreibungen, R\u00e4umungen, Verfolgungen, Ermordungen usw. entwendet, was wiederum die Versch\u00e4rfung des Krieges im Land vorangetrieben hat. Mit diesem Gesetz offenbart der Staat, dass er nur 2000 Hektar zur\u00fcckgeben will, und f\u00fcgt hinzu, dass dieser Prozess Sache der finanziellen Tragf\u00e4higkeit sein sollte. <\/p>\n Die finanzielle Tragf\u00e4higkeit ist ein zweischneidiges Schwert. Zum Einen erkennt der Staat einen Bauern als legitimen Eigent\u00fcmer eines Grundst\u00fccks und auch die Tatsache, dass das Land durch Gewalt entrissen wurde, an. Zum Anderen aber sagt er, dass, obwohl der Bauer vollen Anspruch darauf hat, dieses Recht nur dann ausgef\u00fchrt wird, wenn es innerhalb des Staatshaushaltes genug Geld gibt. Es wird also im Gegensatz das Land nicht an die legitimen Eigent\u00fcmerInnen und Opfer dieser Gesetze des Krieges, welche die Bauern, Indigenen und AfrokolumbianerInnen sind, zur\u00fcckgegeben. \u201eDiese ganze Politik hat einen kapitalistischen Schwerpunkt und ist von Aggression gegen die Gesellschaft gepr\u00e4gt\u201c, f\u00fchrt ein traditioneller F\u00fchrer der Nasa aus. <\/p>\n Da das Ziel der Versammlung war, verschiedene Themen auszuf\u00fchren und zu kontextualisieren, wurde auch im speziellen vom Cabildo (Gemeinderat) gesprochen. Dabei wurde die Ankunft der multinationalen Konzerne, der Drogenhandel, die Pr\u00e4senz der legalen und illegalen bewaffneten Gruppen und der Kauf gestohlener Motorr\u00e4der besprochen und dar\u00fcber, dass die traditionelle Autorit\u00e4t das Geeignetste w\u00e4re, um territoriale Kontrolle zu erreichen und die Gewalt zu vermindern. <\/p>\n \u201eEs ist keine leichte Aufgabe, sich mit diesen Themen auseinanderzusetzen. Aber wir sind im Moment dabei einige sehr konkrete Aktionen durchzuf\u00fchren: beaufsichtigen, wer in unser Territorium kommt und mit welchen Zielen. Weiters wurde eine Datenbank erstellt, um herauszufinden, wer gestohlene Motorr\u00e4der gekauft hat und sie jetzt als Transportmittel verwendet. Auf diese Art tragen wir dazu bei, die Diebst\u00e4hle zu verringern.\u201c, bemerkt der Gouverneur des Cabildo. <\/p>\n \u201eHeute ist es unsere Aufgabe, f\u00fcr uns selbst Sorge zu tragen und eng mit der Autorit\u00e4t zusammenzuarbeiten. Wir m\u00fcssen uns aber auch bewusst machen, dass so wie die gestohlenen Motorr\u00e4der unser Territorium destabilisieren, uns der Krieg und der Drogenhandel zerst\u00f6ren. Der Anbau der illegalen Pflanzen tr\u00e4gt zu der Tatsache bei, dass sie uns verfolgen und t\u00f6ten. Deshalb arbeiten wir gemeinsam, um diese Probleme auszul\u00f6schen.\u201c, \u00e4u\u00dfert die Gemeinschaft. Dieser Ver\u00e4nderungsprozess bleibt als Aufgabe erhalten.<\/p>\n \u00a0<\/p>\n \u00a0<\/p>\n The Critical about the laws and the mining<\/strong><\/p>\n The indigenous community of Tacuey\u00f3 met on the 30th of August 2011 to talk about the situation of the armed conflict, the land, the drug-trafficking, the mining and the laws which are affecting the community in their territory of North Cauca. In this assembly the context was analyzed with the help of people working in these areas, as well as community members and governors. <\/p>\n One of these topics was the governments policy concerning the \u201eminero-energ\u00e9tica\u201c, which \u201ewas designed to supply multinational enterprises with mineral oil, water and gold. These enterprises claim a huge part of Colombia and her rich mineral deposits. Anglo Gold Ashanti for example owns a great deal of the concessions for minerals which can be found on indigenous territory. Because of the extensive mining, these territories have changed into war zones, just like it happened in Tacuey\u00f3.\u201c, says a participant of the assembly. <\/p>\n This policy is accompanied by various laws, which have been modified and adapted to ensure the continuation of the mining operations. \u201eThe ground and the subsoil used to belong to the nation. Nowadays the subsoil belongs to the state, due to the implementation of law 685. Therefore the state has the territorial control and the power to decide which private persons receive the precious land titles\u201c, adds a community member. <\/p>\n The statute of rural development, a law with great influence on the indigenous communities, has been declared unsustainable for not being in accord with the ILO convention, which means consulting the communities concerning issues that affect them. Today the government ist trying to revive this law, which has been declared unconstitutional, under the new name of \u201elaw of rural development\u201c. This is supposed to further the modernisation of the country. But what does this mean for the persons concerned? In the end it is about letting the peasants, afro-colombians and indigenous people work for the enterprises and make them build huge streets, on which the riches of the land and the fruits of their work will be carried away. <\/p>\n Another topic of the assembly was the law of the victims and compensation of land. This law legalises 5000 of the overall 7000 stolen hectares. This ground was stolen from the peasants through forced\u00a0 and violent displacements, evictions, persecutions and assassinations. All this played part in exacerbating\u00a0 the war in the country. Through this law the government reveals that they are only willing to return 2000 hectares and that this process is subject of financial capacity. <\/p>\n The financial capacity is a double-edged sword. On one hand, the state recognizes the peasants as legitimate owners of plots of land and the fact that this land has been wrested from them through violence. On the other hand, the state claims, that although the peasant is in fact fully entitled to his land, this law will only be executed if there is enough money in the national budget. On the contrary, the land does not get returned to their rightful owners and victims of those laws of war, the peasants, afro-colombians and indigenous people. \u201eThis whole policy has a capitalist emphasis and is characterised by aggression against the society\u201c, states a traditional Nasa leader. <\/p>\n They also talked about the Cabildo in particular, since the aim of the assembly was to talk about various topics and to provide context. Topics concerning the Cabildo were the arrival of multinational enterprises, drug-trafficking, the presence of legal and illegal armed groups and the purchase of stolen motorbikes. They agreed that the traditional authority was the most suitable way to achieve territorial control and to reduce the violence. <\/p>\n \u201eIt is not an easy task to talk about these matters. But right now we are realising very concrete actions: we are supervising who sets foot on our territory and why. We also created a database to find out who bought stolen motorbikes and uses them now as a means of transportation. This way we are contributing to the reduction of the number of thefts.\u201c, remarks the governor of the Cabildo. <\/p>\n \u201eToday it is our task to look out for ourselves and to work closely with the authorities. We have to be aware of the fact that just as the stolen motorbikes are destabilizing our territory, war and drug-trafficking are destroying us. The cultivation of illegal plants adds to the fact that they are persecuting and killing us. This is why we work together to solve these problems.\u201c, expresses the community.
