\t Recientemente cumplimos 44 a\u00f1os de aquella fecha hist\u00f3rica en la que nuestros mayores de los cabildos ind\u00edgenas del norte del Cauca, progenitores valientes, humildes y coherentes con los principios y valores del pueblo Nasa y Misak retomaron las banderas de resistencia de nuestros ancestros fundando en el a\u00f1o de 1971 el Consejo Regional Ind\u00edgena del Cauca-CRIC.<\/p>\n

<\/p>\n

\t La historia de la invasi\u00f3n espa\u00f1ola a los territorios ind\u00edgenas y el tratamiento a los pueblos nativos fue inhumano, inquisitivo y genocida. Sin embargo, en esta regi\u00f3n en la cual permanecemos, ocupamos y resistimos hasta el d\u00eda de hoy no lograron tal prop\u00f3sito en vista de la respuesta valiente y valerosa de nuestros antepasados, obligando al virreinato espa\u00f1ol reconocer la propiedad del territorio a trav\u00e9s de t\u00edtulos coloniales, bajo la figura de resguardos.<\/p>\n

\tDe lo corrido en la historia republicana, las \u00e9lites criollas no solo preservan la descendencia gen\u00e9tica de los invasores, sino tambi\u00e9n heredaron las pr\u00e1cticas horrorosas de guerra y violencia para mantener la osad\u00eda de usurpar de diferentes maneras la propiedad de las tierras ancestrales que la corona espa\u00f1ola no nos pudo arrebatar. Estos criollos de manera fraudulenta disolvieron muchos de los resguardos y los territorios ancestrales escritur\u00e1ndolos a su ej\u00e9rcito.<\/p>\n

\tEn la historia reciente de Colombia, resultado del pacto constitucional de 1991 se reconocen derechos colectivos a los pueblos ind\u00edgenas del pa\u00eds, sin embargo respecto a la propiedad integra de los territorios ancestrales la situaci\u00f3n no cambia, al contrario, el poder econ\u00f3mico del pa\u00eds, la \u00e9lite terrateniente y los gobierno de turno han recrudecido la guerra genocida y violenta contra los pueblos que reclaman su derecho al territorio institucionaliz\u00e1ndola a trav\u00e9s de las Fuerzas Militares y de Polic\u00eda (ESMAD).<\/p>\n

\t                                                                 HECHOS:<\/strong><\/p>\n

\t Desde el d\u00eda 14 de diciembre de 2014, hombres, mujeres, mayores, guardias, j\u00f3venes ind\u00edgenas atendiendo los mandatos comunitarios iniciaron acciones de liberaci\u00f3n de la madre tierra en la parte plana de Corinto, despu\u00e9s de permanecer y ocupar pac\u00edficamente los predios denominados: Miraflores, Quebrada Seca, Garc\u00eda Arriba, Granaditas. Las exigencias por el derecho al territorio se han extendido hasta el sector de La Agustina-Santander de Quilichao en la v\u00eda panamericana que comunica al departamento con el sur y centro del pa\u00eds, reclamos iniciados a mediados de febrero.<\/p>\n

\t Despu\u00e9s de la orden impartida por el Gobierno Nacional para el desalojo de los ocupantes de los predios y el desbloque de la v\u00eda panamericana se han presentado las siguientes violaciones a los derechos humanos a partir del uso indiscriminado de la fuerza y el uso de armas largas para acallar las justas reclamaciones:<\/p>\n

\t El Tejido de Defensa de la Vida y los DDHH de ACIN, registra que en los \u00faltimos 4 d\u00edas (24, 25, 26 y 27 de febrero) de arremetida por parte la Fuerza P\u00fablica ej\u00e9rcito, polic\u00eda ESMAD se han presentado 53 afectados por parte de las comunidades ind\u00edgenas movilizadas, heridas que seg\u00fan descripci\u00f3n medica se registran as\u00ed: heridas abiertas causada por arma contundente, heridas abiertas causadas por objeto corto punzantes, heridas de alto compromiso causada por impacto de arma de fuego, contusiones hematomas en diferentes partes del cuerpo, y compromisos oculares. los afectados han sido atendidos en los hospitales de Corinto, Miranda y Santander de Quilichao, entre los heridos hay 5 comuneros que por su gravedad fueron remitidos al  Hospital Universitario del Valle nivel III en la ciudad de Cali, 3 de los cuales registran herida por arma de fuego.<\/p>\n

\t Lo anterior se ha dado por la desmedida e ilegal utilizaci\u00f3n de la fuerza, pues se han empleado las armas TRUFLY (lanzagranadas de gas) como arma contundente y letal al disparar de manera directa contra la humanidad de los ind\u00edgenas, utilizaci\u00f3n de armas corto punzantes (machetes) y disparos de arma de fuego. Manifestamos que existe asedio y acciones de judicializaci\u00f3n de los ind\u00edgenas heridos en el Hospital Universitario del Valle, a los tres les han retenido su documentaci\u00f3n.<\/p>\n

\t Tambi\u00e9n se registra restricci\u00f3n a la misi\u00f3n m\u00e9dica por parte de la Fuerza P\u00fablica en los lugares en que la comunidad se manifiesta, seguimientos a autoridades ind\u00edgenas y guardia, registro fotogr\u00e1fico indebido a comuneros ind\u00edgenas, estigmatizaciones y se\u00f1alamiento.<\/p>\n

\t En momentos en que se redacta este comunicado se conoce de la arremetida por parte del ESMAD a los lugares donde se encuentran los v\u00edveres y las cocinas de los manifestantes en el sector de La Agustina-Santander de Quilichao y, en la vereda Pueblo Nuevo del municipio de Corinto se presenta una situaci\u00f3n similar.<\/p>\n

\t En medio de estas acciones en la tarde del d\u00eda de ayer 27 de febrero por medios de comunicaci\u00f3n han circulado lo que ser\u00eda la tercera amenaza mediante panfleto del grupo paramilitar los Rastrojos que junto con las \u00c1guilas Negras intentan inducir miedo en la poblaci\u00f3n. Tambi\u00e9n ayer, en horas de la tarde lleg\u00f3 una nueva amenaza, esta vez contra la emisora Radio Pa\u2019Yumat del Tejido de Comunicaci\u00f3n de la ACIN. Esta amenaza lleg\u00f3 v\u00eda celular a varios integrantes del Tejido de Comunicaci\u00f3n desde el n\u00famero 3207538360, dice: \u201cSAPOS TRIPLE HP LES RECOMENDAMOS MODERAR EL LENGUAJE POR ESA PUTA EMISORA O NO RESPONDEMOS POR USTEDES, SOLICITAMO A FELICIANO V, GOB DE CORINTO Y LOS LLAMADOS CONSEJEROS PARA Q CORRIJAN SUS MENTIRAS X SUS MEDIOS.”<\/strong><\/em><\/u><\/p>\n

\tEl 26 de febrero, la gobernadora de Huellas Caloto MARGARITA HILAMO recibi\u00f3 una amenaza, tambi\u00e9n v\u00eda celular, desde el numero celular 3156957400 en donde le dicen \u201cTIENEN 24 ORAS PARA QUE LEVANTEN ESA GUARDIA QUE ESTA ENSEGUIDA DEL PUEBLO ONO RESPONDEMOS NO QUE REMOS ESOS SAPOS ENLA VIA PASADO 24 ORAS INO ACATAN MIS ORDENES SONDE CLARADO OJETIVO MILITAR DES D EL VALLE LAS \u00c1GUILAS NEGRAS ASIENDO LINPIESA\u201d<\/u><\/em><\/strong><\/p>\n

\t Rechazamos con contundencia los comunicados firmados por grupos autodenominados Rastrojos, \u00c1guilas Negras en los cuales amenazan a los cabildos ind\u00edgenas del norte del Cauca, a la ACIN, al CRIC y a la ONIC, a l\u00edderes y a colaboradores de estas organizaciones a quienes han declarado objetivo militar en distintos panfletos que han aparecido en la zona desde finales del a\u00f1o pasado y que en horas de la ma\u00f1ana del d\u00eda de hoy s\u00e1bado 28 de febrero distribuyeron por diferentes lugares de la regi\u00f3n.<\/p>\n

\t Lo parad\u00f3jico de la anterior situaci\u00f3n es que el norte del Cauca es una de las zonas de mayor concentraci\u00f3n de personal activo de las Fuerzas Militares, haciendo presencia con batallones de Alta Monta\u00f1a en los municipios de Corinto, Miranda, Toribio, Caloto y Jambal\u00f3, as\u00ed mismo con personal permanente en el corredor vial entre los municipios de Miranda, Corinto, Caloto y Santander de Quilichao, adem\u00e1s de contar con estaciones de polic\u00eda en cada uno de estos municipios, lugares donde en lo corrido del a\u00f1o 2015 se han presentado 52 personas asesinadas: 40 en el municipio de Santander de Quilichao, 5 en el corredor de la v\u00eda Caloto-Corinto y 7 alrededor del municipio de Caloto, seg\u00fan datos presentados en la presentaci\u00f3n del II informe del Frente Amplio por la Paz en el corregimiento de El Palo del municipio de Caloto el 25 de febrero de 2015.<\/p>\n

\t Instamos al Gobierno Nacional que en el menor tiempo posible adquiera los predios que demandan las comunidades ind\u00edgenas del norte del Cauca ubicadas en los municipios de Miranda, Corinto, Caloto y Santander de Quilichao.
\t Hacemos un llamado a los empresarios del Valle del Cauca y en particular a la agroindustria de la ca\u00f1a a ser coherente con la campa\u00f1a \u201cSoy Capaz\u201d lanzada el pasado mes de septiembre de 2014 a que cedan y oferten las tierras que demandan las comunidades ind\u00edgenas del norte del Cauca.<\/p>\n

\t Alertamos a los organismos internacionales de Derechos Humanos, al Alto Comisionado para los Derechos Humanos de Naciones Unidas, a las Instituciones, Procuradur\u00eda General de la Naci\u00f3n y a la Defensor\u00eda del Pueblo para que est\u00e9n atentos a los abusos y posibles violaciones a los derechos humanos de los pueblos ind\u00edgenas
\t Llamamos a la Defensor\u00eda del Pueblo, para que haciendo presencia en la zona y en ejercicio de las funciones asignadas constitucional y legalmente, verifique la situaci\u00f3n descrita y de inicio a las acciones que haya lugar en contra de la Fuerza P\u00fablica.<\/p>\n

\t A la Procuradur\u00eda General y Procuradur\u00eda Municipal, para que desplieguen las acciones pertinentes en materia de Derechos Humanos y Disciplinarias en observancia de su resorte misional. A la Fiscal\u00eda General de la Naci\u00f3n, para que d\u00e9 inicio a las investigaciones a pertinentes, a partir de la situaci\u00f3n de vulneraci\u00f3n de Derechos Humanos en contra de los Pueblos Ind\u00edgenas identificados en la zona.<\/p>\n

\t A la Oficina del Consejero Presidencial para los Derechos Humanos, para que dentro del resorte de sus funciones direccione todos los esfuerzos necesarios para garantizar la legalidad y el respeto a los Derechos Fundamentales de los Pueblos Ind\u00edgenas concentrados en el departamento del Cauca.<\/p>\n

\t A las agencias internacionales (ACNUR, OACNUDH, PNUD, CIDH, CICR entre otras) y dem\u00e1s organizaciones de la sociedad civil (CODHES, CCJAR, INDEPAZ, entre otras), para que en el marco de sus funciones misionales exijan al Estado Colombiano, realice las acciones necesarias para garantizar y proteger sus derechos e informen a la comunidad nacional e internacional sobre la grave situaci\u00f3n que afrontamos los Pueblos Ind\u00edgenas en Colombia por el riesgo latente de extinci\u00f3n f\u00edsica y cultural que afrontamos en la actualidad.<\/p>\n

\tASSOCIATION OF INDIGENOUS COUNCILS FROM NORTHERN CAUCA-COLOMBIA: TO NATIONAL AND INTERNATIONAL PUBLIC OPINION. WE DEMAND OUR RIGHTS BY LIBERATING OUR MOTHER EARTH<\/strong><\/span><\/div>\n

\tWe recently celebrated the 44 anniversary of that historical date when the our courageous and humble elders from the Misak and Nasa indigenous cabildos (councils) from northern Cauca retook the flags of resistance of our ancestors and founded the Regional Indigenous Council of Cauca, CRIC, in 1971.   <\/div>\n
\t <\/div>\n
\tThe history of the Spanish invasion of the indigenous territories and the treatment of indigenous people was inhuman, inquisitive and genocidal.  However, in this region where we stand and resist until today they did not achieve this purpose due to the brave resistance of our ancestors. This forced the Spanish crown to recognize, throughout colonial titles and the institution of \u201cresguardo,\u201d our legitimate possession over our ancestral territory.  <\/div>\n
\t <\/div>\n
\tThrough the republican history, the Colombian creole elite do not only preserve the genetic descendant of the Spanish invaders, but they also inherited their horrific practices of war and violence in order to usurp the ancestral territories the Spanish were not able to seize. The creole elite fraudulently dissolved many of the cabildos and ancestral territories in favor of their armed forces.  <\/div>\n
\t <\/div>\n
\tIn the recent Colombian history, the Constitutional pact of 1991 recognizes collective indigenous rights. However, the situation has not changed in regard to the lack of respect for the autonomy and rights over our ancestral territories. On the contrary, the economic power of the landowner elite and all the Colombianadministrations have employed their armed forces (the military forces and the police \u2013 ESMAD) in order to increase the genocidal and violent attack against the people who claim their rights over their territory.   <\/div>\n
\t <\/div>\n
\t                                                                 FACTS:<\/strong><\/div>\n
\t <\/div>\n
\tSince December 14, 2014, men, women, elders, guards, and indigenous youthare attending the community\u2019s mandate in regard to the liberation of the mother earth in the flatlands of the municipality of Corinto. They have occupied peacefully the farms named:   Miraflores, QuebradaSeca, Garc\u00eda Arriba, Granaditas. In February 2015,the demands for territorial rights have been extended to La Agustina-Santander de Quilichiao in the Pan-American Highway that connects the south and the center of Colombia.  <\/div>\n
\t <\/div>\n
\tAfter the government\u2019s order for the eviction of the occupants and the unlocking of the Pan-American Highway, the participants on this mobilization have endured different human rights violations due to the fact that the ESMAD and the Army are using excessive force and large weaponry:<\/div>\n
\t <\/div>\n
\tThe Tejido de Defensa de la Vida y los DDHH de ACIN registers that in the 24, 25, 26 and 27 of February, there have been 53 injured by the armed forces, more specifically the ESMAD. According to medical records, the injuries are as follows:open wounds caused by firearms, open wounds caused by sharp weapons, bruises on different parts of the body, and multiple eye wounds. The wounded have been attended in hospitals located in Corinto, Miranda, y Santander de Quilichiao. Five of them had to my referred to the Hospital Universitario del Valle in Cali due to their critical situation. Fromthesefive, threewerewoundedbygunfire.<\/div>\n

\tThis crisis is happening for the excessive and illegal use of force by the Colombian armed forces. The ESMAD has been using weapons TRUFLY (gas grenade launcher) as a lethal weapon fired directly against humanity of indigenous as well as short sharp weapons (machetes) and gun shots.<\/div>\n
\t <\/div>\n
\tIn addition, there is harassment and prosecution actions of the wounded indigenous in the Hospital Universitario del Valle since the police has retained their documentation.<\/div>\n
\t <\/div>\n
\t Restriction on the medical mission by the security forcesis also recorded as well as surveillance over indigenous leaders and the indigenous guard. We also denounce that the policy is constantly taking pictures and harassing people in and around the places these manifestations occur. <\/div>\n
\t <\/div>\n
\t At a time when it is drafted this statement, the Police is attacking the places where the protestors had storage their food and their kitchens in the La Agustina-Santander de Quilichao and in the village of Pueblo Nuevo in the municipality of Corinto. <\/div>\n
\t <\/div>\n
\tIn the midst of these actions on the afternoon of February 27, we have received a third dead threat signed by two paramilitary organizations Rastrojos and Aguilas Negras. In addition, the Tejido de Comunicacion de la ACIN and its radio station Radio Pa\u2019 Yumat received a dead threat on Febuary 26. This threat were received on the cellphones of several members of the Tejido de Comunicacion from the number 3207538360. \tOn February 26, the indigenous Governor from Caloto, MARGARITA HILAMO, also received a threat via phone from the cell number 3156957400. \tWe stronglyreject these dead threats signed by the paramilitary groups Rastrojos and \u00c1guilas Negras which threaten leaders, employees and solidarities of indigenous councils of Northern Cauca, ACIN, the CRIC and ONIC. These paramilitary organizations have declaredthem military targets through various pamphlets that have appeared and distributed through different parts of the region.<\/div>\n
\t <\/div>\n
\t The paradox of the above situation is that northern Cauca is one of the areas with the highest concentration of active personnel of the Armed Forces. They have battalions in the municipalities of Corinto, Miranda, Toribio, Caloto and Jambal\u00f3. They also have permanent staff in the corridor between the municipalities of Miranda, Corinto, Caloto and Santander de Quilichao, in addition to police stations in each of these municipalities. Meanwhile, 52 assassinations have been happened only in these few weeks of 2015: 40 in the town of Santander de Quilichao, 5 viaCorinto toCaloto and 7 around the town of Caloto, according to data presented by the FrenteAmplio para la Paz in the district of El Palo deCaloto the February 25, 2015.<\/div>\n
\t <\/div>\n
\tWe urge the Government in the shortest possible time to acquire the properties demanded by indigenous communities in northern Cauca in the municipalities of Miranda, Corinto, Caloto and Santander de Quilichao.<\/div>\n
\t <\/div>\n
\tWe call on the businessmen of Valle del Cauca and in particular the ones related to the sugarcane agribusiness to be consistent with the campaign “SOY CAPAZ” launched last September 2014 to cede and to offer the lands demanded by indigenous communities northern Cauca.<\/div>\n
\t <\/div>\n
\t We alert international human rights organizations, the High Commissioner for Human Rights of the United Nations, Institutions, Procuraduria General Office and the Defensordel Pueblo to be attentive to the abuses and possible violations of human rights against Indigenous peoples. <\/div>\n
\t <\/div>\n
\t We call to the Defensordel Pueblo, so that a presence in the area and in exercise of the constitutional and legally assigned functions, verify the context and start to actions that may take place against the security forces.<\/div>\n
\t <\/div>\n
\tThe Procurador General and the Procurador Municipal Attorney to deploy relevant actions in post of discipline and prevent Human Rights violations against indigenous people. The Fiscal General to launch the investigation on the situation of human rights violations against indigenous peoples identified in the area.<\/div>\n
\t <\/div>\n
\tThe Office of the Presidential Adviser for Human Rights to fulfill its functions  to route every effort to ensure the respect for the Fundamental Rights of Indigenous Peoples in the department of Cauca.<\/div>\n
\t <\/div>\n
\tWe urge the international agencies (UNHCR, OHCHR, UNDP, IACHR, ICRC and others) and other civil society organizations (CODHES, CCJAR, INDEPAZ, etc.), that under his missionary duties, require the Colombian State to carry the actions necessary to guarantee and protect of indigenous rights as well as to inform the national and international community about the critical situation facing Indigenous Peoples in Colombia due to the latent risk of physical and cultural extinction.<\/div>\n
